Kill Protected Birds Expect Fines And Jail Time

Last June Charles Belgard, 21 years old, drove a Jeep about 70 mph through 10 flocks of seabirds on the Long Beach peninsula in Washington. This week he was delivered his sentence.

Sharnelle Fee, Director of the Wildlife Center of the North Coast said:

It wasn’t just a one-time down the beach thing. He was driving up and down the beach though multiple flocks. It was especially egregious.

He killed over 50 seabirds! Most of the casualties were Heermann’s Gulls and Caspian Terns which are protected under the Migratory Bird Treaty Act of 1918.

Federal law lists this type of violation as a misdemeanor, but Charles was charged under Washington state law where animal cruelty is a felony! The judge awarded him 45 days in jail and a $1,050 fine!

Sharnelle Fee:

We really appreciate their effort and their attempts to show that this is serious. It just sends a message that not only is this cruel but also there are repercussions if you’re caught.

    $1,050 seems light. Just happy he didn't walk away and I hope this news gets out.

    Seems some type of community service that would help him learn to appreciate nature and life would have been appropriate (in addition to the sentence he received).

    People like this are ill and all the prison time and fines in the world will do nothing for the problem. There should be places in the country where people like this are sent to be healed because they lack connections with their emotions and empathy for others. Google “Puppies Behind Bars” for one example how restoring empathy can work.

    I think 45 days is about right, but the fine should have been much more painful to his pocketbook, considering the high death toll and his blatant disregard for wildlife. What a punk.

    His actions certainly are heinous. If he killed 50 birds due to his repeated actions, he got off easy.

    I agree with you. Sharnelle said he went “up and down the beach though multiple flocks”. Just horrible! I really like Lisa's idea about having him to do “some type of community service that would help him learn to appreciate nature”. Maybe at a wildlife rehabilitation center.

    What is the matter with people, I wouldn't dare to tell you what I would have awarded him , I don't think justice was served in this case, but then again our justice system is so broken.
